Terms of Service
These Terms of Service ("Terms") govern your use of the PetitionHQ platform at petitionhq.com and app.petitionhq.com (the "Service"), operated by PetitionHQ, Inc. ("PetitionHQ", "we", "our"). By creating an account or using the Service you agree to these Terms.
1. Who can use the Service
The Service is licensed to licensed attorneys admitted to practice in at least one U.S. jurisdiction and to staff acting under their supervision. By signing up, you represent that you are such an attorney or are authorized by one. The Service may not be used by anyone whose license has been suspended, revoked, or surrendered.
2. PetitionHQ is software, not a law firm
PetitionHQ provides software that helps attorneys prepare federal bankruptcy petitions. We are not a law firm and do not provide legal advice, representation, or services. Every document generated by the Service must be reviewed, signed, and filed by a licensed attorney admitted to the relevant jurisdiction. You — the attorney — remain solely responsible for the accuracy, completeness, and legal sufficiency of any petition filed with a court.
3. Accounts and security
- You must provide accurate information when creating an account and keep it updated.
- You are responsible for safeguarding your credentials and for all activity on your account.
- Notify us immediately at security@petitionhq.com of any unauthorized access.
- One human per login. Sharing credentials across attorneys is prohibited.
4. Client data and attorney-client privilege
Data uploaded to the Service for a particular case is the work product and confidential client file of the attorney's firm. PetitionHQ processes that data solely on the firm's behalf, only as needed to operate the Service. We do not use client case data to train third-party AI models without your explicit consent.
You represent that you have all necessary authority, consent, and legal basis from your client to upload their information to the Service.
5. Fees and billing
- Pricing is shown on petitionhq.com/#pricing. Subscriptions auto-renew until cancelled.
- Private-beta discounts, credits, or evaluation terms apply only when confirmed in writing at sign-up. Plan fees and per-case overage fees apply according to the accepted order or checkout terms.
- All fees are exclusive of taxes; you are responsible for applicable taxes.
- If your account is past due, we may suspend access to the Service until balances are paid.
6. Cancellation and refunds
You may cancel your subscription at any time from the Account settings. Cancellation takes effect at the end of the current billing period. Refunds or credits, if any, are handled case by case in writing; per-case overage fees are non-refundable. After cancellation, you may export case files for 30 days; after that, files may be permanently deleted.
7. Acceptable use
You agree not to:
- Use the Service for any purpose other than preparing bankruptcy petitions for clients you represent.
- Submit false, fraudulent, or knowingly misleading information.
- Attempt to reverse-engineer, scrape, or circumvent technical protections.
- Interfere with other firms' workspaces or attempt to access cases you do not own.
- Use the Service to provide unauthorized practice of law in any jurisdiction.
- Resell, sublicense, or expose the Service to third parties as a hosted offering.
8. Intellectual property
PetitionHQ retains all rights in the Service, including software, templates, calculation engines, and documentation. We grant you a non-exclusive, non-transferable, revocable license to use the Service for the duration of your subscription. You retain ownership of case data and outputs generated for your clients.
9. Third-party services
The Service relies on third-party providers (cloud hosting, document processing, AI inference, email). Their performance affects ours. We are not liable for third-party outages, but we will work in good faith to restore service.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT GENERATED PETITIONS WILL BE FREE OF DEFECT. The attorney is responsible for reviewing every field before filing.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETITIONHQ AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID PETITIONHQ IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold PetitionHQ harmless from claims arising out of: (a) your use of the Service in violation of these Terms; (b) your unauthorized practice of law; (c) the accuracy or sufficiency of petitions you file; or (d) your violation of third-party rights, including attorney-client and privacy obligations.
13. Termination
We may suspend or terminate your account for material breach of these Terms or for non-payment, with notice where practical. You may terminate at any time. Sections 4, 5, 7–14 survive termination.
14. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-laws principles. Any dispute will be resolved exclusively in the state and federal courts located in New York County, New York, and you consent to the jurisdiction and venue of those courts.
15. Changes
We may update these Terms from time to time. Material changes will be posted here with a new "Last updated" date and communicated by email or in-app notice. Continued use of the Service after an update constitutes acceptance.
